the head of the constitutional court of Russia Valery Zorkin has held that the decision of the European court of human rights ordered Russia to pay former shareholders of Yukos compensation of 1.9 billion Euro, violates the principles of equality and justice.
Zorkin reminded that even the Strasbourg court found that YUKOS used the “massive scheme of tax evasion”, RIA “Novosti”.
In this regard, the requirement to pay the former shareholders of Yukos “unprecedented amount” of the budget, which has not received sales tax payments of the company, contrary to the constitutional principles of equality and justice, stated the judge.
however, the court ruled that Moscow may voluntarily produce certain payments to the former shareholders of Yukos. On account payments can go the company’s funds in foreign accounts, the costs and revenues of the Russian budget and the property of the country should not be affected.
on Thursday, the constitutional court decided that Moscow would not comply with the decision of the European court of human rights and not to pay 1.9 billion euros in compensation to former Yukos shareholders.
At the same time Russia does not waive the obligation to execute the decisions of the ECHR, but intends to perform only regulations relevant to the Constitution.
