the Expert working group at the Federal level under the chairmanship of Minister for Open government Mikhail Abyzov rejected an online petition on the abolition of anti-terror “package of Spring”, which gained 100 thousand votes on the website of the Russian public initiative (ROI). The experts of the working group felt it more appropriate not to cancel completely “Spring package”, and to finalize it. In particular, to reduce the amount stored by Telecom companies to the citizens, to introduce a phased implementation of the “Spring pack” in terms of data storage and to conduct a pilot project for its implementation in a particular area of the country.
Yesterday the meeting of the expert working group of the Federal level under the chairmanship of Minister for Open government Mikhail Abyzov. At this meeting, was reviewed by the online petition on the abolition of anti-terror “package of Spring”. This petition has been published on the website ROI 27 Jun 2016 and a month and a half gained 100 thousand votes required for consideration at the Federal level.
this online petition, it follows that anti-terrorist “package of Spring” is contrary to the Constitution of the Russian Federation and is absolutely useless from a technical point of view. “Please repeal this law, since the law requires a lot of money, may lead to the bankruptcy of many Internet companies and to reduce the state income from taxes received from them,” reads the online petition.
the Assertion that anti-terrorist “package of Spring” is contrary to the Constitution, appears to be wrong, said yesterday at a meeting with the Deputy Minister of communications and mass communications Alexei Volin.
with regard to costs and bankruptcy of companies, the Ministry of communications and mass communications of the Russian Federation (Ministry of communications) in collaboration with the Ministry of industry and trade of the Russian Federation (Minpromtorg) and representatives from the security forces conducted a series of meetings and consultations aimed at reducing the costs of the industry from performing anti-terrorist “package of Spring,” said Alexei Volin.
In particular, the Ministry of communications proposes to minimize the cost of operators in the first phase of the implementation of anti-terror “package of Spring” to eliminate the storage of redundant information, namely, Internet video, IPTV and other types of data, providing up to 80% of the traffic.
the Ministry of communications proposes the gradual “deepening” of information storage. To date, operators are required to store information for 12 hours. “We understand that the transition from the shelf life from 12 hours shelf life of six months can be carried out immediately. This transition can be gradual. That is, first, to “deepen” the retention period to two weeks, then to months, then two months, and then have to go to six months,” said Alexei Volin.
taking into account the above proposals of the Ministry of communications will estimate the cost of Telecom operators on the implementation of anti-terrorism “package of Spring” in the amount of about 100 billion rubles.
However, according to preliminary estimates, JSC “Mobile TeleSystems” (MTS), taking into account proposals of the Ministry of communications to reduce the volume of stored data, the operator will have to spend more than 400 billion roubles for the implementation of anti-terror “package of Spring”.
In turn, Vice-President of MTS, corporate and legal issues Ruslan Ibragimov yesterday at the meeting of the working group chaired by Mikhail Abyzov suggested to conduct a pilot project on the implementation of the “Spring package” on a particular area of the country.
In General, the expert working group decided to reject the online petition on the abolition of anti-terror “package of Spring”. Still, the working group prepared for various state agencies a number of recommendations for further work with anti-terrorist “package of Spring”. In particular, it recommended that the Government of the Russian Federation to carry out additional assessment of the technical, organizational, financial, economic and social aspects of the application of the norms of anti-terrorism “package of Spring”. Also the Russian Government was recommended to consider the position of the expert working group in the preparation of relevant normative legal acts.
In turn, the working group plans based on the proposals, which were announced yesterday at a meeting during the week to prepare an expert opinion related to the implementation of anti-terrorist “package of Spring”.
As previously reported by the newspaper Vedomosti, the Federal Antimonopoly service (FAS) and the Ministry of economic development of the Russian Federation (MEDT) believe that “Spring package” requires adjustment (see news ComNews on January 19, 2017).
OJSC “MegaFon” supports the readiness of the authorities to discuss and change anti-terrorism “package of Spring”. “It must be substantially modified to clarify the types, the amount of stored information, and most importantly to study the scenario of transmission to a state of functionality for the collection and storage of traffic. This will improve the efficiency and safety, since all activities will be concentrated in one authority using common technology. It is possible that it is necessary to delay the entry of the law into force”, – said the Director of government relations “the Megaphone” Dmitry Petrov.
the Law will enter into force from 1 July 2018. Recall that July of 2016, Russian President Vladimir Putin signed anti-terrorism “package of Spring”. Also Vladimir Putin has given instructions to a number of agencies providing for further elaboration of certain provisions of the anti-terrorist “package of Spring” and, if necessary, amend it (see news ComNews dated July 7, 2016).
the Amazing situation is that anti-terrorist “package of Spring” was adopted six months ago, but not yet presented data that clearly will define what information will be kept, in what format, at what time and by what technical solutions, said yesterday at the meeting Mikhail Abyzov. “Six months have passed. The term is more than sufficient to have the answers to these questions. Too bad that they are not. But even worse, if we do not give in the near future”, – said Mikhail Abyzov.
