Medvedev approved the rules of compensation to tourists – RBC

The government approved the disbursement rules for compensation of tourists damages that arose because of the failure tour operator with its obligations. The decision comes into force from January 1, 2017

Prime Minister Dmitry Medvedev signed a government resolution “On the procedure for reimbursement of actual damages tourists means personal responsibility fund operators in the field of outbound tourism.” The document was published on the website of the cabinet.

According to the explanatory memorandum, the decision is intended to ensure “the protection of consumers’ rights in the field of outbound tourism and the” creation of an effective real damage compensation mechanism to tourists “.

Earlier, the federal law 49-FZ, which provides for the formation of the personal responsibility of tour operators Fund for compensation for damage resulting from non-performance tour operator with its obligations. Medvedev signed a decree determines the order of payment. “Rules are defined the persons entitled to make claims for compensation for actual damages before the actual date of departure to the country of temporary stay of the contract on the implementation of the tourism product,” – said in a memorandum

The law provides for the establishment of a fund for. compensation for damage to tourists. Association of tour operators have 90 days to form a registry of tourists, which the actual damage caused. After that, within ten working days should be considered tourists complaints and decided to pay compensation. Within three days after the decision on damages association of tour operators directs tourists notice in writing.

If the funds accumulated in the fund of the tour operators, not enough to meet all the requirements, the payments are reduced and are made in proportion to the amount of damage.

The decision was signed August 10. It shall enter into force on 1 January 2017.

The government has also issued a decree “On measures to increase the responsibility of tour operators.” This decision of the government defines the list of the documents confirming compliance with the official tour operator requirements of the law and order the person submitting documents to the authorized federal executive body. The established order concerns tour manager, his deputy and chief accountant.
