Russia has decided to appeal to the District Court The Hague arbitration decision, it is obliged to pay the former shareholders of Yukos 52.4 billion dollars.
According to the website of the Ministry of Finance of the Russian Federation on January 28, filed three applications for annulment of the decisions of international arbitration in three parallel proceedings, which are considered in Russia, contrary to the decisions of the independence of the Chamber of the European Court of Human Rights.
“Both chambers unanimously agreed that the JSC” NC “YUKOS” engaged in large-scale tax evasion, that decisions about their additional accrual of “NK” Yukos “were lawful and comply with the legislation of the Russian Federation that the Russian authorities were not politically motivated, as well as that of “NC” YUKOS “are not discriminated against,” – says the Russian Ministry of Finance.
International Court of Arbitration in The Hague, is considered” Yukos affair “for almost ten years, in July last year found Russia guilty of violating the Energy Charter due for de facto expropriation of Yukos.
In addition, at the same time the ECtHR awarded ex-Yukos shareholders compensation of 1.9 billion euros (2.4 billion dollars). This included fines, which the Russian Ministry for Taxes and Levies imposed on Yukos in 2000 and 2001 during a tax audit, as well as the return of the 7 per cent performing the collection, which was charged to the company.
In December panel of five judges of the European Court of Human Rights has rejected an application for review of Russia in the Yukos case, then the Minister of Justice of Russia Alexander Konovalov said that Russia has agreed to accept the decision of the ECHR, although it considers it to be unfounded.
