Pele filed a lawsuit against Samsung’s $ 30 million – RBC

Brazilian footballer Pele sued for $ 30 million to Samsung Electronics Korean manufacturer for the misuse of his double in advertising, writes the Chicago Tribune.

In the claim sent to the beginning of March, in the name of Pele, affirms that Samsung illegally used double Pele in advertising TVs. Advertising has appeared in The New York Times in October last year. By this time, Samsung broke off negotiations with Pele on the use of his image.

Although the advertisement mentions Pele directly, it contains a large photograph of an elderly man black man, who “is very reminiscent of” the great Brazilian. Thus, advertising can mislead consumers and harm the interests of Pele, say lawyers. In this regard, the lawsuit states that Pelé in the past has signed advertising contracts with companies such as Procter & amp; Gamble, Volkswagen, Emirates airline and a network of Subway restaurants, which make up a large part of his income. Lawyers estimated the damage to the Brazilian from the illegal use of his image in advertising in Samsung’s $ 30 million.

Pele was negotiating with Samsung at the end of 2013, when “the last moment [the company] came out of the talks and has not received the right use the image of Pele in any form and in any format, “according to the lawsuit.

As the Chicago Tribune, Pele went on the way basketball player Michael Jordan. Moreover, he has hired lawyers who helped Jordan to win the case.

Michael Jordan by the Federal Court challenged the right to use his image in the network Dominick’s supermarket advertising. Law firm Schiff Hardin in August 2015 helped him to seize $ 8.9 million.

However, points out Chicago Tribune, Jordan’s case is more obvious because of Dominick’s directly used his name.
