Russian President Vladimir Putin instructed the government until July 15 to prepare a law on “offshore amnesty.” This follows from the list of orders signed by the Head of State, on realization of the Address to the Federal Assembly on December 4, 2014.
According to the presidential commission charged with Cabinet amend the law, which will provide “one-time release of Russian officials from the tax and criminal responsibility on the condition return the said persons in the Russian jurisdiction previously derived by them in foreign jurisdictions without paying appropriate taxes income derived from sources in the Russian Federation. ”
The proposal to hold offshore amnesty capital on the eve of Putin made during his address to the Federal Assembly. “I propose to carry out a full amnesty capital returning to Russia – it was full,” – he said.
The President explained that “if a person legalize their money and property in Russia, it will get a solid legal guarantees that its will not carry on various bodies, including law enforcement, shake it here and there, do not ask about the sources and methods of obtaining capital that he will not face criminal or administrative prosecution and it is not an issue with the tax authorities and law enforcement agencies ».
« Let’s do it now, but once. And everyone should take advantage of it, who wants to come to Russia “, – said the president.
Business and government officials of the economic block with spring negotiate deofshorizatsii. However, it was only a tax amnesty and certainly not indulgences associated with criminal and administrative prosecution. Putin’s proposal surprised both business and officials of financial and economic block of the government. “Vedomosti” newspaper quoted one of the officials, who calls the president’s proposal “a little too liberal.” “Specific proposals for conducting large-scale amnesty was not, we did not expect such a clear indication of the capital amnesty, it was a pleasant surprise,” – said on the eve of RBC, a source close to the leadership of the RSPP, commenting on the proposal of the President.
«There are moments that require discussion,” – said the head of RBC Alexander Shokhin. In particular, the question of whether it is necessary to take taxes from the money that had been placed in the trusts that manage personal capital, and structured, including, in Anglo-Saxon law – in cases where the corresponding Russian law. “For example, in Anglo-Saxon law is a conditional gift, inheritance, we have no such mechanisms,” – he said.
The difficulties may be with regard to personal trusts, which are not used for financial circuits and are not an commercial operations: “We need to make a decision on amnesty, in the sense that such trusts taxes are not taken,” – said the head of RSPP. At the same time the law comes into force on the CIC, which involves notification of shares in companies, including trusts.
«It is important to decide on all aspects of the amnesty, which is still not completely clear, to the point how to fully enter into force law on the CIC [1 January 2016], or increase the transition to CFC, in order to prepare for an amnesty. At the same time, except for the whip should be and stick – incentives to return capital to the country, among them – the legislation to support the establishment of holding companies in Russia, “- says Shokhin.
